A subcontractor may be engaged only if this is provided for in the tender documents and the contracting authority's approval has been obtained; the entire work may not be subcontracted. The contractor remains liable to the contracting authority, and the use of a subcontractor does not remove this liability. A list of the work intended to be performed by subcontractors is submitted to the contracting authority at the tender stage; during contract performance, engaging a subcontractor without approval is deemed non-compliance.
